If you do not agree with the Terms and Conditions of Viet FRESHMART MINIMART, please do not use or access the Site. Your access or use of the Site implies your acceptance of the Terms and Conditions set forth herein. A. Viet FRESHMART MINIMART (hereinafter referred to as "Viet FRESH") is a corporation organized and existing under the laws of the Republic of the Philippines, with an address at 1208 P. Ocampo St. Brgy. 757, San Andres Bukid, Manila City, Metro Manila.B. Viet FRESH is an online delivery service that enables consumers to purchase items from us and have these items delivered to their doorstep.

II. General

A. Viet FRESH services shall include receiving orders through its Site and mobile application and facilitating deliveries by our riders or delivery app riders to your designated address.
B. Viet FRESH is responsible for the quality of the items offered by us. All questions regarding products or items featured on the Site should be directed to us.
C. As part of the registration process on the Site, Viet FRESH may collect personally identifiable information about you, including Name (first and last), e-mail address, mobile phone number, demographic profile (e.g., age, gender, occupation, education), and information about your interactions with the Site. The collection and use of this information are subject to our Privacy Policy, which is an integral part of these Terms and Conditions.

III. Children's Privacy

A. Viet FRESH is committed to protecting the privacy of children who use our services. We do not knowingly collect personal information from children under 13 without verifiable parental consent.

IV. Ordering

A. Any contract for purchasing items from this Site is between you and Viet FRESH. You agree to provide accurate and complete details at the time of ordering. You also warrant that the credit or debit card details you provide are your own and that you have sufficient funds to make the payment.
B. Items and goods purchased from this site are intended for your personal use, and you warrant that any items or goods purchased by you are not for resale and that you are acting as principal only and not as an agent for another party.
C. Some items or goods featured on the Site may be suitable for certain age ranges only. You should check that the product you are ordering is suitable for the intended recipient, especially if the recipient is a minor.
D. When ordering from this Site, you may be required to provide a contact number and password. You must ensure that you keep your e-mail and password secure.
E. Viet FRESH will take reasonable care to keep the details of your order and payment secure. However, Viet FRESH cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.
F. Any order that you place with us is subject to product availability, delivery capacity, and acceptance by us. Upon placing your order online, Viet FRESH will send you an SMS to confirm that we have received your order. This confirmation is merely an acknowledgment of our receipt of your order.
G. If the ordered items are available, Viet FRESH will accept your order and confirm it. Once the details of the order are verified, you will receive a text message (SMS) confirming your order placement, which will include an order number, total price, and estimated delivery time.
H. If the items or goods ordered are unavailable or if Viet FRESH is unable to render the delivery service, we will notify you by sending you a text message (SMS) or giving you a phone call.

V. Prices and Availability of Items

A. The information on the Site regarding prices, specifications, and availability of the items/products listed is provided by us. Prices are inclusive of the relevant sales tax and other fees.
B. Viet FRESH reserves the right to modify the items available for sale on the Site or stop listing items.
C. Prices, specifications, and availability of products/items may differ and are subject to change, especially if the delivery or pick-up date differs from the order placement date.
D. Viet FRESH strives to ensure accuracy in posting pricing information but does not guarantee that discrepancies will not occur. If you become aware of inaccurate information on the Site, please notify us immediately.

VI. Payment

A. Any transaction for the purchase of items or goods from this Site is between you and Viet FRESH. You agree to exercise due care when providing us with your details and warrant that these details are accurate and complete at the time of ordering.
B. The total price for items or goods, including delivery charges and other charges, will be displayed on the Site when you place your order. Full payment must be made for all items or goods dispatched either in cash or through online payment. If you choose Cash on Delivery (COD), Viet FRESH will pick up and deliver the purchased items to you and collect the payment upon delivery.

VII. Delivery

A. Estimated delivery times made during ordering are approximations and may vary depending on road traffic. Items or goods will be delivered to the address designated by you when placing your order.
B. If items are not delivered within the estimated delivery time, you may contact us by telephone or e-mail. Viet FRESH is committed to ensuring that you receive your order in a timely manner.
C. If you fail to accept delivery of items or goods despite timely delivery by Viet FRESH, or if we are unable to deliver at the nominated time due to your failure to provide appropriate instructions or authorizations, the items or goods shall be deemed delivered to you, and all risk and responsibility in relation to such items or goods shall be borne by you. You shall indemnify Viet FRESH for any storage, insurance, or other costs incurred due to your refusal to accept delivery without valid and reasonable cause.
D. Viet FRESH shall not be liable for any losses, liabilities, costs, damages, charges, or expenses arising from late delivery when the cause of the delay is solely attributable to your fault or negligence.

VIII. Return and Refund Policy

A. In case of a late delivery, the delivery charge will neither be voided nor refunded by Viet FRESH.
B. Only non-perishable items or goods may be returned to Viet FRESH, subject to our return policies.
C. No returns or refunds are permitted after the items or goods have been accepted by you or your representative upon delivery.
D. If perishable items or goods are delivered in unsatisfactory condition, please contact us immediately upon receipt to discuss potential remedies.

IX. Cancellation

A. Viet FRESH may cancel a transaction if the product is unavailable for any reason. You will be notified of this, and any payment already made will be refunded to you.
B. Viet FRESH reserves the right to cancel any order(s) for the following reasons: Suspicion of fraudulent or suspicious transactions.
Transactions not in accordance with these Terms and Conditions.
Inability to perform delivery services due to reasons beyond our control, including logistical difficulties, force majeure, and other unforeseen events.
Customer-initiated cancellations.
C. Viet FRESH reserves the right to deny access to non-compliant users or cancel their orders at any time without notice.

X. Representations or Warranties

A. Viet FRESH does not make any representations or warranties regarding the availability of items or goods on the Site nor does it expressly or impliedly support or endorse the sale or purchase of any items or goods on the Site.
B. Viet FRESH strives to display available items or goods accurately, including their appearance, color, size, shape, and description. However, we are not liable for any inconsistency or inaccuracy in appearance, especially regarding color.
C. You acknowledge and agree that Viet FRESH acts as your agent for retrieving and delivering items or goods purchased on the Site and has no relationship with you other than providing such retrieval and delivery services. Viet FRESH holds no right, title, or interest in such items or goods and is not responsible for damages or delays due to items being out of stock, unavailable, or back-ordered.

Viet FRESH will not be liable for any delay or failure to deliver items or goods ordered or for any damages or losses that result from causes beyond our control, including but not limited to acts of God, war, riots, embargoes, strikes, fires, floods, accidents, or failures of public transportation systems.

These Terms and Conditions and the relationship between you and Viet FRESH will be governed by and construed in accordance with the laws of the Republic of the Philippines.
